Hi NYC Community,

I am writing to see how you are dealing with the bill that is now on the Governors desk for signature. We have 60 days to make adjustments to our websites once this is signed. As usual I am researching other ticketing websites to see how this is being managed and have an example below. I also highlighted important parts of the bill that seem to pertain to us. 

Would love to share ideas. Presently the tickets have to be in the cart and then you proceed to checkout to see the fees. I like how Ticketmaster presents the information. We have different fees for our performances and can have a mixed cart.

2021-2022 Legislative Session

Enacts into law components of legislation that relate to live event ticket sales; institutes civil penalties for utilizing ticket purchasing software; increases civil penalties currently in place and institutes new penalties for second offenses for licensees (Part A); requires full ticket prices to be disclosed prior to a customer purchasing such ticket;  requires such price to remain the same during the purchase process (Part B); prohibits the resale of a ticket if such ticket was initially offered to the public at no charge (Part C); requires online resale marketplaces to clearly and conspicuously disclose the established price charged by the operator of a place of entertainment that is printed or endorsed on the face of each ticket (Part D); allows reasonable and actual costs to be charged for the physical delivery of certain tickets (Part E); extends the effectiveness of certain provisions relating to tickets to places of entertainment (Part F).

SUMMARY OF PROVISIONS: Part B of this bill amends subdivision 4 of section 25.07 of the Arts and Cultural Affairs Law to require sellers and resellers of tickets to disclose the total cost of a ticket and clearly and conspicuously disclose the amount of the price that is made up of fees and other charges. The disclosure of the total price and fees shall be displayed in the ticket listing prior to the ticket being selected for purchase. The price of a ticket may not increase during the purchasing process. The total price of a ticket must be disclosed at the beginning of a transaction at the first instance a price is shown. Such disclosure can't be misleading, the components of the total price may not be displayed more prominently or in a larger font than the total cost. This part takes effect 60 days after the effective date of the act.

    For those who are TNEW users, we are aware of this regulation, and from our initial review, the current TNEW fee disclaimer functionality already supports the need to communicate fees to a customer in addition to the price of the ticket before they add it to the cart. You can read more about it on https://www.tessituranetwork.com/TNEW_7/TNEW.htm#Topics/Pages/Event_Item_Detail.htm and go to the “Price Type & Quantity” section.  

    Fees can be displayed separately from the price for each price type by setting Fee Disclaimer Displayed to true in the Product Type Editor. The message can be customized by editing the Fee Disclaimer property.

    I'm also seeing that TNEW-based orgs will also likely want to take a moment with the "Fees Grouped a a Single Line Item" option from Component Editor - Cart (to manage the detail on both Cart and Payment pages). We're all figuring out how many times and where we'll need to list out our fee details, so I thought I'd pop this into the chain just for reference.

    However, I'm also motivated by a question--I do not consistently see the Fees appear on our Cart page at all. I just experimented a little and can confirm that, though I've added a balcony seat for the same performance to one session in my main browser window and another in an Incognito window, the "Processing Fees" subtotal line is not universally present. I've noticed this in the past too, but wasn't specifically looking at it and wasn't able to itemize it as a concern. I had a hypothesis that it had to do with being logged in, but doing so didn't change what I saw.

    Is this intended behavior that we should all understand the conditions of? Or, should I open a unique support ticket for the New Victory site?

  • Thank you for adding to the thread. Looking forward to your resolution to share with all. Our Web team is reviewing our options and if you are experiencing discrepancies there is the chance that non-TNEW users might experience the same.

  • Appending my earlier question with an answer from Tessitura Support:

    We were not "consistently" seeing the Fees appear on the Cart page because our settings connected them to specific Delivery Methods--therefore, they were clearly displayed once the user hit the checkout step that selected a Delivery Method. Once one existed for the order/session, the fees show up. 

    Luckily for us, this was more the result of not needing to determine specifics before rather than being driven by business rules. We're easily able to adjust settings so that our fees show up without a direct connection to Delivery Method. 

    Since this is about Tessitura set up rather than something TNEW-specific, I assume this is relevant info for many of us. I hope it's either as easy an adjustment for your orgs as it was for us, or it's something you have already accounted for.
